Planning commission's Thursday agenda includes motel appeal, area plan, Rattlesnake Island

LAKEPORT – A motel owner's appeal of a notice of violation, the Middletown Area Plan and a grading and building project on Rattlesnake Island off of Clearlake Oaks will go before the Lake County Planning Commission this Thursday.


The commission will meet beginning at 9 a.m. Thursday, May 13, in the Board of Supervisors chambers at the Lake County Courthouse, 255 N. Forbes St.


At 9:05 a.m. the commission will consider an administrative appeal from Veronica Fisher, owner of the El Dorado Motel, located at 3955 Lakeshore Blvd., in the unincorporated area of Lakeport.


The county issued Fisher a notice of violation on Sept. 9, 2009, alleging that she converted her 12-unit facility from a motel to a combination of longterm and transient rentals.


Fisher, in turn has stated that she did not convert her facility. She has presented a letter from a former county planner showing that her use was considered grandfathered.


At 10 a.m., the commission will hold a public hearing to consider making a recommendation to the Board of Supervisors on the draft Middletown Area Plan and the rezoning of lands within the area plan. Commissioners also will discuss certifying the plan's final environmental impact report.


The proposed document would amend the general plan and rezone portions of the approximately 150 square miles of unincorporated area that includes the communities of Middletown, Hidden Valley Lake and Anderson Springs along with the outlying rural areas. It provides guidance on land use and development decisions in the Middletown planning area through the year 2030.


At 1:30 p.m., the commission will hold a public hearing to consider a mitigated negative declaration based on an initial study for a California Environmental Quality Act grading permit for John Nady, who owns Rattlesnake Island, located offshore of Clearlake Oaks.


For several years Nady has been working through planning processes in order to move forward with building on the island, which members of the Elem Colony of Indians say is sacred to them.


Nady is proposing grading activities with a view to building a residence, a caretaker’s cabin, standalone bathroom and utility trenching.
