ORDINANCE NO. 2945

AN ORDINANCE INCREASING THE CHARGES AND FEES FOR

COUNTY SERVICE AREA NO. 2 – SPRING VALLEY LAKES


The Board of Supervisors of the County of Lake ordains as follows:


Section 1: The following charges and fees for C.S.A. No. 2 are hereby approved and adopted:


1. Charges for Water Service.


a. Metered water service per month:


(1) A base charge of $25.00 up to and including 600 cubic feet per month.


(2) A charge of $2.75 per 100 cubic feet in excess of 600 cubic feet up to and including 1,000 cubic feet per month.


(3) A charge of $5.50 per 100 cubic feet in excess of 1,000 cubic feet per month up to and including 2,000 cubic feet per month.


(4) A charge of $8.00 per 100 cubic feet in excess of 2,000 cubic feet per month.


b. Standby Charges: $6.00 per month


A service connection is eligible for standby rates if there is zero usage for four (4) or more months.


c. Metered water service shall be billed every two months.


d. Water hydrants:


(1) A charge of $50.00 to set hydrant meter.


(2) A base charge of $30.00 per month.


(3) A charge of $2.75 for each 100 cubic feet per month.


(4) Charges for water hydrants shall be due upon receipt of billing.


e. The charges established by subdivisions a. through c. shall be twice those indicated when the service is provided in territory located outside the boundaries of the CSA.


 

2. Miscellaneous Charges.


a. Late Charge - A monthly late charge of 10% of any portion of bill that is past due. Payment is considered past due when not received within 30 days following the mailing of the notice that payment is due.


b. Lock Off and turn on charges:


(1) A charge of $24.00 to shut off service made upon request of recipient of service.


(2) A charge of $24.00 to turn on service made upon request of recipient of service.


(3) An additional charge of $58.00 when the CSA is required to lock off service because of the failure to pay charges.


c. Account setup charges:


A charge of $24.00 each time an account is setup for ownership change or rental contract.


d. Rental deposit - When service is made to property being rented or leased, the tenant shall be required to complete a Renter’s Contract and deposit $92.00 with the County. The deposit made pursuant to this provision is refundable to the depositor thereof, upon the complete payment by tenant of the closing statement of charges, or when the tenant becomes legal owner of record, whichever occurs first.


e. Cut locking device charge - A charge of $125.00 each time a meter-locking device is cut off by non-county personnel. This charge is in addition to any costs to repair or replace damaged equipment.


f. Capital Improvement Program: Per SFD equivalent, $7.20 per month


3. Line Connections


a. Metered line connections:


(1) A charge of $797.00 for the installation of a water meter.


(2) A charge of $400.00 for each additional meter installed on the same property and at the same time.


(3) The cost for installation of a water meter and tap to the main line is as follows:


(A) A charge of $800.00 for five-eighths by three-quarter inch meter.


(B) A charge of $1,000 for one-inch meter.


(4) A charge based on the cost of material and labor shall be due for any meters or meter and taps not covered by the provisions of subdivision (1), (2), and (3) above. Any person or entity requesting the installation of a meter pursuant to this subdivision shall deposit the amount of $1,000.00 with the County. In the event the total cost, as determined by the County exceeds said deposit, the deposit shall be credited to the total amount due for such costs. In the event the total costs is less than such deposit, the difference between the deposit and the total cost shall be refunded within a reasonable amount of time of the completion of work.


4. Capital Improvement Fee


a. There shall be fees for any new construction or addition to existing structures and facilities in the following amount.


(1) Single Family Dwelling Equivalent $19,217.00


b. When a specific connection type is not addressed, fees will be calculated on the flow data provided in an approved capacity analysis.


Section 2: Charges and fees set forth in Paragraphs 3 and 4, shall be adjusted for inflation on May 1st of every year. Beginning May 1, 2012, these charges will be adjusted using the Engineering News Record-Construction index (ENR). In the event of a negative index, no change in the water charges and fees shall be made.


Section 3: All ordinances or resolutions in conflict herewith are hereby repealed to the extent of such conflict and no further.


Section 4: This ordinance shall take effect on the 12th day of April, 2011 and before the expiration of fifteen (15) days after its passage, it shall be published at least once in a newspaper of general circulation printed and published in the County of Lake.



The foregoing Ordinance was introduced before the Board of Supervisors on the 5th day of April, 2011 and passed by the following vote on the 12th day of April, 2011.
