Board of Supervisors: Ordinance amending charges for Mt. Hannah County Service Area

ORDINANCE NO. 2949

AN ORDINANCE AMENDING THE CHARGES AND FEES FOR

COUNTY SERVICE AREA NO. 22- MT. HANNAH



The Board of Supervisors of the County of Lake ordains as follows:


Section 1: The following charges and fees for C.S.A. No. 22 are hereby approved and adopted:


1. Charges for Water Service. ___2011 ___2012 __2013


a. Metered water service:


(1) Base charge: $27.00 $28.05 $29.50


(2) Tier 1: Usage up to 750 cubic feet per month -per hcf. $ 2.00 $ 2.38 $ 2.62


(3) Tier 2: Usage between 751 and 1,501cf per hcf $ 4.33 $ 4.77 $ 5.24


(4) Tier 3: Usage over 1,500 cf – per hcf $ 6.75 $ 7.65 $ 8.07


b. Water services for private fire protection facilities:


(1) For facilities utilizing eight inch diameter pipe the charge shall be $45.00 for each month.


(2) For facilities utilizing six inch diameter pipe the charge shall be $35.00 for each month.


c. Water from water hydrants:


(1) A charge of $50.00 to set meter.


(2) A base charge of $25.00 per month.


(3) A charge of $4.77 for each 100 cubic feet per month.


(4) Charges for water hydrants shall be due upon receipt of billing.


d. Beginning on January 1, 2014, and on January 1st each year thereafter, the charges listed in items a. through c. shall be adjusted based on inflation. The inflationary adjustment shall be determined by multiplying the current rate by the ratio of the prior year’s average annual U.S. City Average Consumer Price Index as published by the U.S. Department of Labor, Bureau of Labor Statistics. In the event of a negative index, no change shall be made in the charges and fees.


2. Miscellaneous Charges.


a. Late Charge - A monthly late charge of 10% of any portion of bill that is past due. Payment is considered past due when not received within 30 days following the mailing of the notice that payment is due.


b. Collection Fee – A charge of $48.00 will be added to any account that is referred to an outside collection agency or requires a lien to be filed for delinquent payments.


c. Shut off and turn on charges:


(1) A charge of $20.00 to shut off or turn on service made upon request of recipient of service.


(2) A charge of $40.00 when the District is required to shut off service because of the failure to


pay charges.


d. Rental Deposit


When service is made to property being rented or leased, the tenant shall be required to deposit with the District the amount of $110.00. The deposit made pursuant to this provision is refundable to the depositor upon the complete payment by tenant of the closing statement of charges.

e. Capital Improvement Program – Per month per SFD equivalent: $ 2.50 $5.00 $8.00


f. Loan Repayment - A charge of $5.00 monthly per connection. This charge is made for the purpose of repaying loans totaling $43,000 from County Revolving funds for emergency repairs to the system. The loans and interest shall be paid in full by 2030. At such time the loans are paid in full, the $5.00 per month will be added to the Capital Improvement Program for repairs and replacement reserves.


3. Line Connections


a. Metered line connections:


(1) A charge of $450.00 for the installation of a water meter.


(2) A charge of $200.00 for each additional meter installed on the same property and at the same time.


(3) The cost for the installation of a water meter and tap to a main line is as follows:


(A) A charge of $450.00 for five-eights by three-quarter inch diameter meter.


(B) A charge of $525.00 for a one-inch meter.


(4) A charge based on the cost of material and labor shall be due for any meter or meters or meter and taps not covered by the provisions of subdivisions (1), (2) and (3) above. Any person or entity requesting the installation of a meter or meters pursuant to this subdivision shall deposit the amount of $800.00 with the District. In the event that the total cost, as determined by the District exceeds said deposit, the deposit shall be credited to the total amount due for such cost. In the event that the total cost is less than such deposit, the difference between deposit and the total cost shall be refunded within a reasonable amount of time of the completion of the work.


b. Unmetered line connections - A charge of $100.00 for any unauthorized line connection. This charge is in addition to usage and any other charges that may apply as a result of the unauthorized connection. In addition to these charges, the unauthorized connection must be disconnected immediately.


4. Capacity Expansion Fee.


a. There shall be a fee for any new construction or additions to existing structures and facilities in the following amount:


(1) Single family residence $7,360.00


b. A fee for new construction or additions not provided for herein shall be fixed by the Board of Supervisors of the County of Lake on a case by case basis.


c. All fees in items 3 and 4 shall be adjusted for inflation on July 1st of each year. Beginning July 1, 2012, these charges will be adjusted using the Engineering News-Record Construction Index (ENR).


Section 2: All ordinances or resolutions in conflict herewith are hereby repealed to the extent of such conflict and no further.


Section 4: This project is exempt from CEQA requirements in that it can be seen with certainty that there is no possibility that the activity in question will have a significant effect upon the environment.


Section 3: This ordinance shall take effect on the 7th day of July, 2011, and before the expiration of fifteen (15) days after its passage, it shall be published at least once in a newspaper of general circulation printed and published in the County of Lake.


The foregoing Ordinance was introduced before the Board of Supervisors on the 24th day of May, 2011 and passed by the following vote of the 7th day of June, 2011.
