The meeting will begin at 9 a.m., Tuesday, Aug. 16, in the Board of Supervisors' chambers on the first floor of the Lake County Courthouse, 255 N. Forbes St., Lakeport. TV8 will broadcast the meeting live.
In an untimed item, the board will hold the second hearing of an ordinance to regulate medical marijuana dispensaries in the county.
The board approved the document 3-2 – with Supervisor Denise Rushing and Supervisor Jeff Smith dissenting – in its first reading at the Aug. 9 meeting, as Lake County News has reported.
The document can be viewed below or at www.scribd.com/LakeCoNews, along with associated documents.
At 1:30 p.m., the board will hold a public hearing to consider John Nady's appeal of the Lake County Planning Commission's May 2010 decision to require him to complete a focused environmental impact report.
Nady wants to build a residence, a caretaker’s cabin, stand alone bathroom and associated utility trenching, which is offshore from Clearlake Oaks, and which has important cultural significance to the Elem Pomo, who have fought Nady's plans over the past decade.
The commission would not accept a mitigated negative declaration to cover Nady's building project on the island, and instead sought the focused EIR to consider the project's impacts on cultural archaeological resources associated with a California Environmental Quality Act grading permit.
Nady is asking the board to overturn the planning commission's vote, accept the mitigated negative declaration and authorize the Community Development Department to grant him the necessary grading permit.
Elem tribal member Jim Brown has asked to make a presentation during the discussion, but said he has not received a response on the request from the Board of Supervisors' office.
Brown has compiled a lengthy report on the island, which he said is sacred to his people. Brown's research shows the island was wrongfully taken from the tribe and allowed to be sold. The document can be seen below.
The board also will hold a closed session to discuss negotiations with the Lake County Employees Association, Lake County Deputy Sheriff's Association, Lake County Correctional Officer's Association and Lake County Deputy District Attorney's Association, and conduct performance evaluations of Air Pollution Control Officer Doug Gearhart and Animal Control Officer Bill Davidson.
A full agenda follows.
