DEA operational plan, dispensaries and PEG fee on supervisors

LAKEPORT, Calif. – The Board of Supervisors this week will consider the sheriff’s proposed operational plan for a federal drug suppression program, and continue discussions on county enforcement actions against medical marijuana dispensaries and funding for the county’s cable access station.


The meeting will begin at 9 a.m. Tuesday, Dec. 13, in the board chambers on the first floor of the Lake County Courthouse, 255 N. Forbes St., Lakeport. TV8 will broadcast the meeting lives.


In an untimed item, the Lake County Sheriff's Office will present to the board for its consideration the proposed 2012 Drug Enforcement Administration Domestic Cannabis Eradication Suppression Operational Plan.


The 14-page report includes a cannabis intelligence overview of the county, and a detailed operational fund request totaling $355,000, which includes $200,000 for aircraft expenses and $125,000 for overtime.


“This year the Lake County Sheriff’s Office has eradicated approximately 170,663 marijuana plants from 42 grow sites, arrested 28 suspects, seized 7 firearms and 2,736 pounds of processed marijuana,” the report states. “Lake County appears to be a focal point for the Drug Trafficking Operations due to the large number of eradicated plants and grow sites. We suspect this is due to the large amount of remote public and private land contained within Lake County and the fact that our enforcement efforts have traditionally been hampered by a lack of funding source, lack of personnel or a combination of both.”


According to the report, 25 percent of the marijuana enforcement took place on public lands and 75 percent was on private lands. Outdoor cultivation accounted for 90 percent of enforcement efforts, with indoor grows responsible for 10 percent.


“Lake County is drastically affected by Proposition 215,” the report explains. “Its supporters will cause increased costs related to investigating marijuana cases and will further impact an already overwhelmed narcotics unit.”


The report further addressed medical marijuana, stating, “Proposition 215 in Lake County continues to have a devastating effect. The number of ‘backyard’ marijuana gardens directly related to the passing of this law has grown to epic proportions. This increase in gardens and the decrease in funding directly influence the manner in which we conduct Proposition 215 investigations, if at all. In 2011, Lake County saw a large rise in claimed medical marijuana grows. We had numerous large 1,000+ plant operations organized by marijuana dispensaries from outside the Lake County Area. More so now than ever, Drug Trafficking Organizations have come (to) Lake County hiding under Proposition 215, and continue to operate and ship marijuana all over the country.”


The report estimated that the amount of cartel-related groups organizing marijuana cultivations operations under Proposition 215 increased by at least 10 times in 2011.


“This year as in years past, Lake County continues to battle with out of state drug traffickers moving to Lake County for the grow season, then returning to their home state where the street value of marijuana is doubled,” the report stated.


If the board has no issues or concerns about the plan, Sheriff Frank Rivero’s memorandum to the board said it will be submitted to the DEA for review by the Dec. 15 deadline.


Also on Tuesday’s agenda, at 9:30 a.m. the board will continue a public hearing – held over from Nov. 8 – on a proposed pass-through fee on Mediacom subscribers to support the county’s cable access station, TV8.


At 1:30 p.m. the board will continue a discussion that began last week on county code enforcement actions against medical marijuana dispensaries. The board agreed last week to delay further action until it formulates a direction for Community Development Department staff.


In an untimed item, the board will discuss a proposed letter to the U.S. Postal Service opposing the proposed consolidation of the Petaluma-based North Bay mail processing facility into the operations of the Oakland facility, which would result in mail service delays in Lake County, as Lake County News has reported.
