Board to hear underage drinking ordinance

LAKEPORT – The Board of Supervisors will consider on Tuesday an ordinance to address underage drinking in private residences, will hold three public hearings and hear the Redevelopment Agency's annual report.

The meeting begins at 9 a.m. in the Board of Supervisors chambers at the Lake County Courthouse, 255 N. Forbes St., Lakeport.

At 11 a.m. the board will discuss a proposed “social host” liability ordinance to enforce prohibitions against serving alcohol to minor and underage drinking.

The cities of Clearlake and Lakeport have already approved underage drinking ordinances to address the issue of minors drinking on private property.

However, the county ordinance would go a step further.

Under the proposed ordinance, social hosts and landowners – including landlords – could be hit with civil fees to recover costs for law enforcement, fire and other emergency response services when they respond to “loud or unruly gatherings,” including those where alcohol is being served to, or consumed by, minors.

In other board business, beginning at 9:15 a.m., the supervisors will hold a public hearing on a Planning Commission recommendation to rezone 164.25 acres at 3000 State Highway 53 in Clearlake, proposed by Peacock Association for Metro PCS, from “unclassified” to “rural residential.”

The proposed rezone is a condition of approving a minor use permit to allow for the replacement of a 51-foot-high utility pole with a 65-foot-high utility pole, on which will be co-located a wireless communication antenna and associated equipment.

A second public hearing, scheduled for 9:30 a.m., will be for the Planning Commission's recommendation to approve a rezone proposed for Niels Holgerson and Charlotte Baylor of a .61-acre parcel located at 555 Live Oak Drive, Kelseyville. The rezone would chance the land's designation from “two-family residential district” to “single-family residential district.”

The day's third public hearing, set for 9:45 a.m., will consider allocation of the Supplemental Local Law Enforcement Services Grant.

At 10 a.m., the Redevelopment Agency will present to the board its annual report for fiscal year 2006-07 for the Northshore Project Area.

Consideration of sheriff's request to amend the amount of call out pay for 900 hour Marine Patrol deputies when called out between 7 p.m. and 7 a.m.

Update from the sheriff's department on emergency action taken on Sept. 25 regarding water damage repairs at the Lake County Jail.

Consideration of Supervisor Anthony Farrington's donation of a county surplus vehicle to Lakeport Senior Center Inc. for use in the Meals on Wheels food delivery program.

Discussion of revisions to the wireless communication devices policies and the proposed resolution amending Resolution No. 2006-166 establishing salaries and fringe benefits for management employees (revising the wireless-communication devices policies to include additional communication devices).
