ORDINANCE NO. 2013-164

AN URGENCY ORDINANCE OF THE CITY OF CLEARLAKE MAKING FINDINGS AND DECLARING A TEMPORARY BUILDING MORATORIUM ON LAKESHORE DRIVE BETWEEN OLYMPIC DRIVE AND OLD HIGHWAY 53

(SUMMARY PUBLICATION)

NOTICE IS HEREBY GIVEN that the Clearlake City Council adopted Ordinance No. 164-2013 on Thursday, October 24, 2013.

The purpose of the ordinance is to enact a temporary moratorium on the issuance of building permits for new construction and major remodels on existing buildings in the “DD,” or Design District, on Lakeshore Drive between Olympic Drive and Old Highway 53.

In order to help preserve the vision for the community and this specific area that has and is being addressed in certain planning documents identified in the ordinance, it is necessary to implement design guidelines and to implement a short moratorium to provide time to do so.

This moratorium shall terminate upon the first to occur of either: the adoption of design guidelines by the City Council on recommendation from the Planning Commission; or three months from the enactment of this ordinance with the provision that a request for extension for an additional three months may be made if the guidelines are not yet enacted.

The ordinance was passed with affirmative vote of Mayor Overton, Vice Mayor Loustalot, and Council Members Luiz, Fortino Dickson and Spittler.

The full text of the Ordinance is available for public review during normal business hours at the Office of the City Clerk, City of Clearlake, 14050 Olympic Drive, Clearlake, CA 95422.
