LAKEPORT – On Wednesday, Sept. 9, Sheriff Rod Mitchell and the Lake County Sheriff’s Office will host a local vendor fair at the Lake County Hill Road Jail Facility.


The fair will take place from 3 p.m. to 7 p.m. pm at the Lake County Jail, located at 4913 Helbush Drive in Lakeport.


Refreshments will be on hand and again, all local businesses are invited and strongly encouraged to attend.


The local vendor fair is presented in cooperation with the county of Lake and is intended to afford local businesses a unique opportunity to come out and view the myriad of services and supplies necessary to sustain sheriff’s office operations.


While local businesses have always been considered in selecting vendors and suppliers, the majority of our business has historically gone to vendors outside of the county due partially to the need for specialized equipment or services and the economic use of tax dollars.


However, in the interest of stimulating the local economy and with the support of the Lake County Board of Supervisors, local businesses have recently been granted particular consideration for the service and supply needs of all county departments.


The sheriff manages the largest operational budget of all county departments and several millions of dollars are spent each year on the services and supplies required to sustain its operations.


Sheriff's officials say they are enthused to take the lead on behalf of all county departments in presenting local businesses with the opportunity to reclaim tax dollars currently spent elsewhere and encourage all local businesses to attend the department's exhibits on Sept. 9.


The local vendor fair will not be restricted to just services and supplies purchased by the jail.


There will be representatives from all branches of the sheriff’s department on hand to discuss and display every aspect of the agency's service and supply needs.

UPPER LAKE – Some area residents arrested last week by federal agents have been released from custody.


Tom Carter, 58, was released from federal custody on Wednesday following a detention hearing that morning in San Francisco, according to US Attorney's Office spokesman Jack Gillund.


“He was released on a $200,000 bond,” said Gillund, explaining that Carter's release was obtained through a combination of a security on his property on Hunter Point Road and his brother's signature.


Carter's wife, Jamie Ceridono – who would not comment on the case – also is being required to surrender her passport, according to court records.


Drug Enforcement Administration officials arrested Carter and three other people – Brett Bassignani, and Scott and Diana Feil – in Upper Lake on Aug. 18, as Lake County News has reported.


A fifth subject, Steven Swanson, 59, of Sebastopol, who is Diana Feil's stepfather, was arrested the same day in Sebastopol.


Gillund said Carter is scheduled to return to federal court in San Francisco at 9:30 a.m. Sept. 2 for a preliminary hearing and arraignment before Magistrate Judge Bernard Zimmerman.


Like Carter, Bassignani, 43, is required to return to San Francisco for a Sept. 2 court appearance. He was released under a set of conditions that included his remaining in the area and a $200,000 bond partially secured by his parents' Nice property.


Warrants for the five made available by the federal courts show that all were arrested on charges of conspiring to distribute marijuana and possess with intent to distribute marijuana, and distributing and possessing with intent to distribute marijuana.


However, the case against Carter and Bassignani is separate from the case against the Feils and Swanson, according to documents released Thursday.


Each of the charges against Carter and Bassignani carry a minimum of five years in federal prison – with a maximum of 40 years – and a possible $2 million fine, as well as supervised release of a minimum of four years up to a maximum lifetime term.


While the Feils and Swanson are facing similar charges, because they're charged with distributing more than 100 kilograms of marijuana between 2002 and 2008, the possible penalties for them are much higher, with minimum prison terms of 10 years or maximum life terms, $4 million fines and five year minimum supervised release.


Gillund would offer no further comment on Carter's case; however, an unsealed complaint against Carter and Bassignani accused them of conspiring with others to sell more than 100 marijuana plants to an informant in May.


A confidential source allegedly called on the morning of May 10, 2006, to arrange to purchase 500 rooted marijuana plant clones from Carter and Bassignani. While the informant is said to have called Carter to arrange the deal, no direct contact was made with Carter and a voice mail was left.


Bassignani allegedly returned the call several minutes later, identified himself as a Carter Construction employee and agreed to deliver the plants to the informant, who was accompanied by two undercover DEA agents, at the Middle Creek Campground north of Upper Lake. The informant allegedly bought the plants for $15 each, or about $7,500.


Bassignani is alleged to have told agents that he was Carter's “plant manager,” and that he was employed “for the sole purpose of caring for marijuana plants, and that his salary was paid for entirely with proceeds from the sale of marijuana.”


Feils, Swanson charged in an unconnected case


Scott Feil, 43, was in court for a custody hearing on Thursday morning and is expected to be released soon. A call to George Boisseau, a Santa Rosa attorney appointed to his case, was not returned.


He and Swanson were listed as the corporate officers of the United Medical Caregivers Clinic medical cannabis dispensary, which had storefronts in Los Angeles and Ukiah. The Feils and Swanson were said to have received salaries from UMCC between 2003 and 2008.


In November of 2005 the DEA and the Los Angeles Police Department conducted a traffic stop on Scott Feil while he was traveling from the Los Angeles area north. During the stop they found and seized approximately $131,132 in cash which Feil said was the proceeds from UMCC marijuana sales that he was transporting on Swanson's behalf. Those funds are part of another federal forfeiture case.


A source reported to the DEA in June of 2007 that Swanson was transporting large amounts of marijuana once a week to the Ukiah club. The Feils are also reported to have bought two Eureka hotels in the last several years.


Then, on July 15 and July 27, the DEA performed aerial surveillance of the Feils' properties on Hunter Point Road and Bachelor Valley Road in Upper Lake, and observed outdoor marijuana cultivation sites. The DEA also spotted an outdoor grow during a flyover at the Feils' Redwood Valley residence.


In addition to the grows, the DEA did “a basic financial analysis of the gross deposits from credit card settlements from transactions occurring at the UMCC storefront locations,” and concluded that the Feils and Swanson allegedly distributed more than 100 kilograms of marijuana from 2002 and 2008.


Diana Feil, 27, was seeking to obtain her release so she could return to work. The family of Swanson, a decorated retiree of the New York Police Department, where he served for 30 years, is putting up security so that he can obtain his release.


It was not clear if Diana Feil and Swanson had yet been released from custody on Thursday.

MIDDLETOWN – The Lake County Sheriff's Office is asking for the community's assistance in gathering more information about an alleged rape case.


Capt. James Bauman said Thursday that the Sheriff’s Major Crimes Unit is seeking help from anyone who may have been in the parking lot of a local casino on the night of July 31 and observed a suspect and an alleged victim leave.


On Aug. 1, a 25-year-old Hidden Valley Lake woman reported she had been raped, Bauman said.


Sheriff's officials arrested 25-year-old John Wesley Dunn of Hidden Valley Lake on Aug. 7 for his alleged connection to the case.


Dunn has remained in the Lake County Jail on $350,000 bail since his arrest. He's appearing in court on Friday for a hearing seeking to reduce his bail so he can be released.


The victim in the case told investigators that she had met family and friends for drinks at Twin Pine Casino in Middletown on the night of July 31. Bauman said when the victim and the suspect left the casino's main entrance their exit was recorded by a casino surveillance camera.


He said casino surveillance also recorded images of three other female patrons who walked out of the casino immediately after the suspect and victim did.


The three women who exited the casino immediately after the victim and suspect are pictured arm-in-arm with each other and appear to all be middle aged with dark hair and medium builds. Bauman said two of the women were wearing capri-style pants with patterned low-neck tops; the third was wearing regular denim pants with a purple shirt.


Bauman emphasized that the unidentified women captured in these surveillance photos are not connected to the crime the Sheriff’s Major Crimes Unit is investigating.


However, he said investigators are very interested in talking to these, as well as any other casino patrons, who may have been in the parking lot at or about the time the suspect and victim left the business shortly after midnight on July 31.


The victim would have been a 25-year-old Caucasian female, approximately 5 feet, 2 inches tall, 125 pounds, with brown hair and brown eyes, and wearing a black dress. The suspect would have been a 25-year-old Caucasian male, approximately 5 feet, 11 inches tall, 265 pounds, very short red hair, brown eyes and wearing an orange pullover shirt. The vehicle the two got in is described as a black, late 1990s Ford Mustang.


Bauman said officials would rather not publish the image of the three women leaving the casino. Instead, its their hope that they may come forward, identify themselves, and share any observations they might remember having of the victim and suspect from the time they exited the casino to the time they got into the suspect’s vehicle that night.


Anyone, including the three unidentified women who exited the casino right behind the victim and suspect, who may have been in the casino parking lot shortly after midnight on the night of July 31 and who thinks they may have seen the suspect and victim leave the business and get into the black Mustang is encouraged to call either Det. LAKE COUNTY – For the first time in California's history, courts across the state will be closed one day a month as a way of addressing California's fiscal crisis.


The decision, made by the Judicial Council of California on July 29, is in response to the “unprecedented statewide fiscal crisis and judicial branch budget reductions,” according to a council statement.


In all, the state's entire judicial branch is facing $414 million in reductions, officials reported.


In July, the state Legislature authorized the Judicial Council to close the superior courts, the Courts of Appeal and the Supreme Court for one day per month, according to the Lake County Superior Court.


All state courts will be closed on the third Wednesday of the month beginning Sept. 16 and running through June 16, 2010, the officials reported. The move is expected to save $94.3 million on a statewide basis.


The council also reallocated $159 million in special funds to offset cuts to the trial court operations budget. In addition, state Chief Justice Ronald M. George indicated he'll take a pay cut, and urged other judges to do the same. Furloughed court employees will be subject to pay cuts.


The Lake County Superior Court reported that the closure days will be treated as holidays for the purposes of scheduling hearings and calculating filing deadlines.


In a statement issued Monday, Presiding Judge Rick Martin said the Superior Court of Lake County received a budget reduction of $406,023 which is 11.9 percent of the court’s budget for the 2009-10 fiscal year.


That has led to the court having to make difficult decisions to absorb this budget reduction while still maintaining access to justice to the residents of Lake County, according to Martin's statement.


To help close the budget gap, Martin's statement noted that all court employees – including judges – have agreed to take the court closure days as unpaid furlough days, which is a 4.62-percent reduction in pay.


Local court staff will continue to work hard to minimize the impact that these closures will have on the public, however longer lines and longer wait times on the telephone should be expected, officials reported.


Chief Deputy District Attorney Rich Hinchcliff said Wednesdays happen to be trial days in Lake County.


Locally, trials typically start on Tuesdays, with anywhere from one to three courtrooms available, Hinchcliff said. The closures will push those trials into the next week.


“The biggest impact it's going to have on us is we have a huge backlog of cases we've got to get out,” said Hinchcliff.


There are not enough courtrooms and trial days now, said Hinchcliff. He estimated there are 150 to 160 felony cases on the criminal trial calendar that are set for trial between now and January. He didn't have an estimate of the number of misdemeanors set for trial.


Stephen Carter, who administers the county's public defender contract through Lake Legal Defense Services Inc., also noted the backlog, which he said is nothing new in the judicial system, with the number of cases that go to trial locally.


Carter said he thinks the mandatory closures “will slow down the process of individual trials,” but shouldn't impact major court calendars, as hundreds of cases currently are handled on Mondays and Fridays.


“The only effect is going to be on ongoing trials,” he said of local courts, with some trials becoming longer. “That's not ideal.”


With the Judicial Council having to respond to the emergency situation, Carter said the Wednesday closures actually work well for the local court system. In some counties, Wednesday are a major calendar day, with the closures having the potential to become a significant issue for court calendar management.


The Judicial Council of California directed that a report be prepared and submitted by next January on the savings from the court closures and the impacts on court users, county justice partners and court operations. The council will use the report to decide whether to continue or reduce the number of monthly closures for the remainder of the fiscal year.


“Hopefully it's going to be temporary,” said Hinchcliff.

LAKEPORT – The ongoing investigation into a local business woman's murder nearly seven years ago is entering a new phase, with Lakeport Police detectives interviewing witnesses and submitting evidence to a state crime lab for evaluation through new testing techniques.


As part of the effort, the Lakeport Police Department is asking anyone with information on the murder of 43-year-old Barbara Gaye LaForge to contact them.


The Governor’s Office has issued a $50,000 reward for information leading to the arrest and conviction of the responsible persons in the murder.


LaForge was shot four times at close range with a .22-caliber weapon at Wildwood Frame Shop and Inspirations Gallery on Main St. in downtown Lakeport on the morning of Oct. 8, 2002.


Her murder is the city's only unsolved homicide, according to police officials.


In April, the Lakeport City Council approved hiring a part-time investigator to dedicate to the case, as Lake County News reported.


The department hired Lou Riccardi, a retired homicide investigator from San Mateo County who now lives in Lake County, to fill the part-time post, and paired him with Destry Henderson, a Lakeport Police officer recently promoted to investigator.


Henderson gets high marks from Riccardi for his efforts on the case. “He's a real hard charger” who has a good way with people, Riccardi said.


Riccardi said he and Henderson have gone through the evidence and reviewed what had, and what hadn't, been submitted for forensic testing to the California Department of Justice Forensic Laboratory.


“Some of the items that were sent had been tested in '02, so I resubmitted them because they have new technology in DNA that we want try and run it through,” said Riccardi.


Over the last seven years great technological advancements in forensic testing having taken place, which leaves investigators hopeful that new clues to the identify of the person – or persons – who killed LaForge will be revealed.


Riccardi said they also collected and submitted several new items for examination.

Meanwhile, he and Henderson presently are interviewing witnesses and following up on

newly received information in the case.


Riccardi said they're getting a lot of interest in the case, thanks in part to a new outreach effort that includes issuing flyers around town.
