Board of Supervisors: Ordinance increasing charges for accepting septic haulers' discharge

ORDINANCE NO. 2941


AN ORDINANCE AMENDING SECTION 721 OF THE SEWER USE ORDINANCE, (APPENDIX A), OF THE LAKE COUNTY ORDINANCE CODE


INCREASING CHARGES FOR ACCEPTING DISCHARGE FROM SEPTIC HAULERS AT THE SOUTHEAST AND NORTHWEST REGIONAL WASTEWATER TREATMENT FACILITIES.


 

WHEREAS, septic haulers discharge at a wastewater treatment plant presents unique challenges, vastly different from discharges into the collection system by property owners connected to the sewer system; and


WHEREAS, the impacts of these discharges to the treatment system can not be borne by property owners connected to the sewer system; and


WHEREAS, these charges can not be addressed through a sewer use ordinance because they are not a consequence of or incidental to sewer use;


THEREFORE, the Board of Directors of the Lake County Sanitation District, State of California,


ordains as follows:


Section 1: Paragraphs (A) and (B) of Section 721 of the Sewer Use Ordinance, (Appendix A), of the Ordinance Code of Lake County are hereby amended to read as follows:


“(A) Sewer service and charges for acceptance of septic effluent for Southeast Regional Wastewater Treatment Plant are as follows:


CHARGE PER GALLON


(22) DISCHARGE FROM SEPTIC HAULERS AT SEWER PLANT 2011 2012


Effluent originating in Lake County, Per Gallon $0.13 $0.20


Effluent originating Out of Lake County, Per Gallon $0.90 $0.90



“(B) Sewer service and charges for acceptance of septic effluent for Northwest Regional Treatment Plant are as follows:

(22) DISCHARGE FROM SEPTIC HAULERS AT SEWER PLANT 2011 2012


Effluent originating in Lake County, Per Gallon $0.13 $0.20


Effluent originating Out of Lake County, Per Gallon $0.90 $0.90



The above charges shall be adjusted February 1 of each year based on inflation beginning February 1, 2013. The inflationary adjustment shall be determined by multiplying the current rate by the ratio of the prior year’s average annual U.S. City Average Consumer Price Index as published by the U.S. Department of Labor, Bureau of Labor Statistics. In the event of a negative index, no change in the sewer charges shall be made. The updated U.S. City Average Consumer Price Index will be posted on Special Districts web site by February 28th of each year.



SECTION 2: All ordinances or parts of ordinances or resolutions in conflict herewith are hereby repealed to the extent of such conflict and no further.


SECTION 3: This Ordinance shall take effect on the 24th day of March, 2011, and before the expiration of fifteen (15) days after its passage, it shall be published at least once in a newspaper of general circulation printed and published in the County of Lake.


The foregoing Ordinance was introduced before the Board of Directors on the 15th day of February, 2011, and passed by the following vote on the 22nd, day of February, 2011:
