LAKEPORT, Calif. – Just a week after giving final approval to a new ordinance governing the county's medical marijuana dispensaries, the Board of Supervisors is set this week to begin discussing an ordinance that will address how cultivation of the plant for medicinal purposes will be handled.
The meeting will begin at 9 a.m. Tuesday, August 23, in the board chambers on the first floor of the Lake County Courthouse, 255 N. Forbes St., Lakeport. TV8 will broadcast the meeting live.
The discussion regarding the proposed ordinance for medical marijuana cultivation will begin at 1:30 p.m.
The new ordinance comes after the board spent its two previous meetings wrapping up the dispensaries ordinance, which has been nearly two years in the making.
The cultivation document will govern cultivation both in homes in residential areas and on properties with an acre or more of land, puts in place performance and operation standards for sites growing for dispensaries and collectives, implements rules for where in homes cultivation can take place, and includes a clause to release the county from liability should arrests and prosecutions based on cultivation-related activities on approved sites take place.
Regarding the liability clause, Community Development Director Rick Coel told Lake County News in a previous interview that he wanted to make sure the county was protected from possible action by federal officials. Earlier this summer federal officials warned officials in other communities around the country about potential criminal liability as a result of approving medical marijuana-related operations.
The board also will hold a closed session to discuss labor negotiations with the Lake County Employees Association, Lake County Deputy Sheriff's Association, Lake County Correctional Officer's Association and Lake County Deputy District Attorney's Association; conduct performance evaluations of Air Pollution Control Officer Doug Gearhart, Animal Control Officer Bill Davidson and Special Districts Administrator Mark Dellinger; and discuss an existing case of litigation, Alvarez et al.
v. Lake County Board of Supervisors et al.
