ORDINANCE NO. 185-2016
AN ORDINANCE OF THE CITY OF CLEARLAKE GRANTING TO GOLDEN STATE WATER COMPANY, A CALIFORNIA CORPORATION, A FRANCHISE TO CONSTRUCT, MAINTAIN AND USE PIPES AND APPURTENANCES, NECESSARY OR PROPER FOR TRANSMITTING WATER UNDER, ALONG, ACROSS OR UPON THE PUBLIC STREETS WITHIN THE CITY OF CLEARLAKE.

NOTICE IS HEREBY GIVEN that the Clearlake City Council adopted Ordinance No. 185-2015 on March 24, 2016.
The purpose of the Ordinance is to grant a franchise to Golden State Water Company under and pursuant to the provisions of Article 1 of Chapter 2 Division 3 of the California Public Utilities Code, commencing at § 6201, for certain purposes, including the construction, maintenance, operation, and/or abandonment of pipelines for the transportation and distribution of water in public streets, ways and alleys in the City.
The grantee of the franchise, Golden State Water Company, and its successors and assigns will, during the life of its franchise, pay to the municipality, City of Clearlake, the percentage specified in its application, that the percentage will be paid annually from the date of the granting of the franchise, and in the event such payment is not made the franchise will be forfeited.
The term of the Franchise is 5 years with a 5 year renewal at the City’s discretion.
The Ordinance was passed with affirmative vote of Mayor Perdock, Vice Mayor Fortino Dickson, and Council Members Overton, Sabatier, and Loustalot.
