Investigation into police shooting continues

CLEARLAKE – The District Attorney's Office and the Clearlake Police are continuing their efforts to piece together the events that took place at a Clearlake trailer park on Monday night, leading to a police officer fatally shooting a man.


Lt. Dave Garzoli of the Lake County Sheriff's Coroner's Division confirmed the man who died in the shooting was 63-year-old David Clinton Vestal.


Four Clearlake Police officers responded to a report of a fight at York's Mobile Park on Old Highway 53 at about 9:30 p.m. Monday night, as Lake County News has reported.


When they arrived at the scene, police reported Vestal pointed a shotgun at officers, with one of them shooting him fatally. A neighbor standing on his patio across the street was hit in the arm by some type of fragment and hospitalized.


Clearlake Police Chief Allan McClain has not released the name of the officer who shot Vestal, and who has been placed on administrative leave according to department policy.


The Department of Justice was called in to process the scene of the shooting, McClain said Tuesday.


Chief Deputy District Attorney Richard Hinchcliff said the District Attorney's Office is investigating the officer-involved shooting, with Clearlake Police continuing its own investigation into the entire incident.


He said it's going to take investigators at least a few weeks to put together a case for review, at which point they'll make a determination on whether or not the shooting was justified.


Clearlake Police on Wednesday said there was no additional information in the case to report, with no new statements from McClain expected until next week.


Park manager Lizbeth Alvarez told Lake County News that Vestal had moved to the park from Clearlake Oaks about a month ago.


She said his daughter and her husband had been fighting, which was the reason police had been called to the scene. Alvarez said Vestal's daughter was arrested at the scene Monday night.


On Wednesday Lake County Sheriff's booking records showed 27-year-old Shavon Marie Vestal was being held in the Lake County Jail on a felony vandalism charge with a $10,000 bond, as well as a felony probation violation and a misdemeanor bench warrant – both of which had no-bail holds. The young woman's booking photo showed she had a badly bruised left eye.


Garzoli said David Vestal's body is due to undergo an autopsy at the Napa County Coroner's Office on July 7.
