REQUEST FOR RELEASE OF FUNDS
On or about August 8, 2008, the City of Lakeport will submit a request to the California Department of Housing and Community Development (HCD) for the release of the Home Investment Partnership Program (HOME) funds under Title 2 of the Cranston-Gonzales National Affordable Housing Act of 1990 as amended, to undertake a project known as the City of Lakeport’s Owner Occupied Rehabilitation Program for the purpose of providing low-interest rate loans for the rehabilitation of housing units to income-eligible households within the City of Lakeport, California. The project in total will utilize approximately Eight Hundred Thousand Dollars ($800,000) in HOME Funding.
The activities proposed are categorically excluded under HUD Regulations at 24 CFR Part 58 from National Environmental Policy Act Requirements. An Environmental Review Record (ERR) that documents the environmental determination for these projects is on file at the City of Lakeport; 200 Park Street, Lakeport may be examined or copied weekdays 9:00 a.m. to 4:00 p.m.
PUBLIC COMMENTS
Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments on the Environmental Review Records to the City of Lakeport, Attn: Trisha Franco, Housing Specialist; 225 Park Street, Lakeport, CA 95453. All comments received by August 6, 2008 will be considered by the City prior to submission of a request for release of funds. Comments should specify which Notice they are addressing.
RELEASE OF FUNDS
The City of Lakeport certifies to HUD/HCD that Richard Knoll in his capacity as Community Development Director consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's/HCD's acceptance of the certification satisfies its responsibilities under NEPA and allows the City of Atwater to use Program Funds.
OBJECTIONS TO THE RELEASE OF FUNDS
HCD will accept objections to its release of funds and the City certification for a period of seven days following the anticipated submission date or its actual receipt of the request (whichever is later) only if it is on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Lakeport; (b) the City of Lakeport has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HCD; or (d) another Federal agency action pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to HCD at 1800 Third Street, MS390, Sacramento, CA 95814. Potential objectors should contact HCD to verify the actual last day of the objection period.
