Notice of Public Hearing - Discussion of Possible State CDBG Program Income Application
NOTICE IS HEREBY GIVEN that the City of Clearlake will conduct a public meeting on July 21, 2021, at 4:00pm at Clearlake City Council Chambers, 14050 Olympic Drive, Clearlake, CA 95422 to discuss possible applications for funding using the State Community Development Block Grant (CDBG) Program Income funds and to solicit public input on possible activities to be included in the application.
Eligible activities consist of: Homeownership Assistance and Housing Rehabilitation Programs; Public Facility and Public Improvement Projects (Including Public Improvements in Support of New Housing Construction); Public Service Programs, Planning Studies, Economic Development Business Assistance and Microenterprise Activities. Eligible activities paid for with State CDBG funds must meet one or more of the three national objectives listed in CDBG federal statues as follows: Benefit to low-income households or persons; elimination of slums and blight; or meeting urgent community development need.
The purpose of this public hearing will be to give citizens an opportunity to make their comments known on the use of the funding.

NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

On or about July 15, 2021 the City of Clearlake will submit a request to the U.S. Department of Housing and Urban Development (HUD)/California Department of Housing and Community Development (HCD) for the release of Community Development Block Grant - Disaster Recovery (CDBG-DR) funds under Public Law 115-254 of the Supplemental Appropriations for Disaster Relief Act, 2018 and Public Law 116-20 of the Additional Supplemental Appropriations for Disaster Relief Act, 2019, as amended, to undertake a project known as City of Clearlake Sulphur Fire Roadway Disaster Repair Project for the purpose of to rehabilitating existing roadways along approximately 8.17 miles of roadway in the northwestern area of the City of Clearlake, estimated funding $13,500,000.
The activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA) requirements but subject to compliance with some of the environmental laws and authorities listed at § 58.5 of 24 CFR Part 58. An Environmental Review Record (ERR) that documents the environmental determinations for this project are on file at the City of Clearlake 14050 Olympic Blvd. Clearlake, CA 95422 and can be viewed or copied during the hours of 9:00 AM to 5:00 PM. PUBLIC COMMENTS

ENVIRONMENTAL CERTIFICATION
The City of Clearlake certifies to HUD/HCD that Alan Flora in his capacity as City Manager consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Clearlake to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
HCD will accept objections to its release of fund and the City of Clearlake’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Clearlake; (b) the City of Clearlake has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HCD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to HCD's Disaster Recovery Environmental Unit at email: This email address is being protected from spambots.
